1. General Terms

These Terms & Conditions govern the purchase and delivery of colour analysis services and digital products from My Colour Season, operated by Colourbella (KVK: 95076174), based in Amsterdam, The Netherlands.

By purchasing any service or product from My Colour Season, you agree to these terms in full.

2. Services and Products Offered

My Colour Season provides seasonal colour analysis services delivered digitally via email in PDF format, as well as downloadable digital products and gift cards.

Colour Analysis Services:

  • Essential Colour Analysis (€39)

  • Complete Colour Analysis with Styling Guide (€67) - Available in men's or women's version

  • Ultimate Colour Analysis with Hair & Makeup Guidance (€97) - Women's version only

Digital Products:

  • Digital Extended Palette Swatch (€12) - Instant download

  • Hair & Makeup Guide (€17) - Instant download

Gift Cards:

  • Available in €39, €67, and €97 denominations

  • Valid for 6 months from date of purchase

  • See Section 16 for full gift card terms

All prices include 21% Dutch VAT.

3. Eligibility

You must be at least 18 years of age to purchase and use My Colour Season services.

By making a purchase, you confirm that you are 18 years of age or older.

We do not knowingly provide services to or collect personal data (including photographs) from individuals under 18 years of age.

If you are a parent or guardian and believe your child under 18 has purchased our services or provided us with personal data, please contact us immediately at hello@mycolourseason.com so we can delete all information and process an appropriate resolution.

4. How Colour Analysis Services Work

Step 1: Purchase

You select and pay for your chosen service tier via our website.

Step 2: Photo Submission

After purchase, you will receive an automated email with instructions to submit photos and complete a brief questionnaire by replying to that email.

Step 3: Analysis

Your colour analysis will be conducted by a certified colour analyst within 3 business days of receiving your complete photo submission and questionnaire responses.

Step 4: Delivery

Your personalized PDF report will be delivered to the email address you provided at checkout.

Digital downloads (Extended Palette Swatch, Hair & Makeup Guide) are available immediately after purchase via your account or email link.

5. Photo Submission Requirements

To complete your colour analysis, you must submit high-quality photos as outlined in the confirmation email within 14 days of purchase.

Required photos typically include:

  • Your face, from the shoulders up, in natural daylight (no makeup, hair pulled back)

  • Your face, from the shoulders up, in indoor/artificial lighting (no makeup)

  • All photos need to be a head-on, straight angle to avoid shadows from side or directly above or below light-sources

If photos are not submitted within 14 days:

  • Your purchase is considered complete

  • No refund will be issued

  • You may submit photos at a later date, but delivery timelines restart from the date of submission

If submitted photos are insufficient for analysis:

  • We will contact you once to request additional or clearer photos

  • Failure to provide adequate photos may result in delayed delivery but does not entitle you to a refund

  • We reserve the right to determine whether photos meet the quality standards necessary for accurate analysis

6. Payment & Invoicing

All payments are processed securely via Squarespace and our integrated payment providers (Stripe, PayPal, or other authorized gateways).

Invoices are issued by Colourbella (KVK: 95076174) and include 21% Dutch VAT as required by law.

Prices are listed in Euros (€). Your bank or payment provider may apply currency conversion fees if paying from outside the Eurozone.

Payment must be received in full before services are rendered or digital products are delivered.

7. No Refunds Policy

All sales are final.

Due to the personalized nature of our services and digital products, we do not offer refunds once your colour analysis has been completed and delivered to you, or once digital products have been accessed or downloaded.

Specifically:

Colour Analysis Services:

  • No refunds once your analysis has been delivered to your email

  • No refunds if you do not submit photos (service availability and analyst time have been reserved for you)

  • Dissatisfaction with results does not constitute grounds for a refund

  • We are happy to clarify your analysis or answer questions, but this does not entitle you to a refund

Digital Downloads:

  • No refunds once the download link has been accessed or the file has been downloaded

  • No refunds for accidental purchases of digital products

Gift Cards:

  • Gift cards are non-refundable and cannot be exchanged for cash (see Section 16)

8. Dutch Consumer Rights (Wet Koop op Afstand)

Under Dutch distance selling laws (Wet Koop op Afstand), consumers typically have a 14-day cooling-off period to cancel online purchases and receive a full refund.

However, this right does NOT apply to My Colour Season services and digital products because:

  • Our colour analysis services involve personalized content created specifically for you

  • Performance of the service begins immediately upon your photo submission (with your explicit consent)

  • Digital downloads are delivered instantly and cannot be "returned"

  • These are exceptions explicitly permitted under Article 6:230p subsection g (personalized goods) and subsection m (digital content) of the Dutch Civil Code (Burgerlijk Wetboek)

By purchasing, you explicitly consent to the immediate performance of services and acknowledge that you waive your right of withdrawal as permitted by Dutch law.

9. Nature of Service: Advice & Recommendations

The colour analysis, styling guidance, and beauty recommendations provided by My Colour Season are professional advice and recommendations only. They do not constitute guarantees or warranties of any kind.

You acknowledge and agree that:

  • Results are based on visual assessment of photographs and questionnaire responses

  • Colour analysis is subjective and interpretive in nature, involving professional judgment

  • Results are recommendations, not guarantees of specific outcomes

  • Implementation of recommendations is entirely at your own discretion and risk

  • Individual results may vary based on personal perception, interpretation, and application

  • We are not liable for any outcomes resulting from your use of the analysis or recommendations

We do not guarantee:

  • That you will be satisfied with your assigned colour season

  • That following our recommendations will achieve specific aesthetic, professional, or personal results

  • That our analysis will match analyses you may have received from other analysts or services

  • That the colours recommended will be universally flattering in all lighting conditions or contexts

Colour analysis involves professional judgment based on established colour theory principles. While we stand behind the quality, training, and accuracy of our work, we acknowledge that colour perception is partially subjective.

10. Intellectual Property

All content delivered to you (PDF reports, digital swatches, styling guides, makeup guides, and all written materials) is protected by copyright and is for your personal, non-commercial use only.

You may not:

  • Resell, redistribute, or share the content publicly (including on social media, blogs, or websites)

  • Use the content for commercial purposes

  • Reproduce, copy, or share the content with others (even friends or family)

  • Claim the content as your own work

  • Modify or create derivative works from the content without permission

You may:

  • Use the content for your personal styling, shopping, and wardrobe decisions

  • Print one copy for personal reference

  • Save digital files to your personal devices

The seasonal colour analysis methodology, content, branding, logos, and all materials are the intellectual property of Colourbella and My Colour Season.

Unauthorized use, reproduction, or distribution may result in legal action.

11. Privacy & Data Protection

We collect and process your personal data (name, email, photographs, questionnaire responses) in accordance with the General Data Protection Regulation (GDPR) and Dutch data protection laws.

Your data is used only to:

  • Deliver your purchased services and products

  • Process payments and issue invoices

  • Communicate with you about your order

  • Provide customer support

  • Improve our services (in aggregate, anonymized form)

We do not:

  • Sell, rent, or trade your data to third parties

  • Use your photos for marketing, training, or any purpose other than your personal analysis (unless you provide explicit written consent)

  • Retain photos longer than necessary to complete your analysis

Data Retention:

  • Photos submitted for analysis are deleted within 30 days of delivering your results

  • Order and payment information is retained for 7 years (Dutch tax and accounting law requirements)

  • Email correspondence is retained for 2 years for customer service purposes

12. Delivery & Technical Issues

Delivery Method:

All colour analysis reports and digital products are delivered via email to the address you provide at checkout.

Delivery Timeframe:

  • Colour Analysis Services: 3 business days from receipt of your complete photo submission and questionnaire

  • Digital Downloads: Instant delivery via download link after purchase

Your Responsibility:

  • Ensure your email address is correct at checkout

  • Check spam/junk/promotions folders if you don't receive your order confirmation or results

  • Contact us within 7 days if you have not received your report or download link

Our Responsibility:

  • If non-delivery is due to an error on our part, we will resend your materials promptly

  • If non-delivery is due to incorrect email information provided by you, we will resend once upon request but are not liable for delays

Technical Issues:

If you experience technical difficulties downloading digital products or opening PDF files, contact us at hello@mycolourseason.com and we will assist you. We may provide alternative file formats or delivery methods when possible.

13. Product Variants

Complete Colour Analysis:

The Complete tier includes a styling guide available in men's or women's version. You will select your preferred version during checkout.

Ultimate Colour Analysis:

The Ultimate tier includes hair and makeup guidance and is designed for women. It includes the women's styling guide by default.

14. Limitation of Liability

To the fullest extent permitted by Dutch law:

  • My Colour Season and Colourbella shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our services or products

  • This includes, but is not limited to: lost profits, lost savings, loss of data, business interruption, or any other commercial damages or losses

  • Our total liability to you for any claim arising from these terms or your use of our services shall not exceed the amount you paid for the specific service or product in question

  • We are not liable for outcomes, results, or consequences resulting from your implementation or application of our recommendations

  • We are not liable for damages resulting from third-party payment processors, email providers, or internet service disruptions beyond our control

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under Dutch law.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (natural disasters, pandemics, etc.)

  • War, terrorism, civil unrest

  • Government actions or regulations

  • Internet or telecommunications failures

  • Power outages

  • Strikes or labor disputes

In such cases, our obligations will be suspended for the duration of the force majeure event.

16. Gift Cards

Validity Period:

Gift cards are valid for 6 months from the date of purchase. After 6 months, the gift card expires and no refund, extension, or credit will be provided.

Redemption:

  • Gift cards can be redeemed for any My Colour Season colour analysis package (Essential, Complete, or Ultimate) or digital product of equal or lesser value

  • If the selected package or product costs less than the gift card value, no refund or credit will be issued for the difference

  • Gift cards cannot be redeemed for cash or used to purchase additional gift cards

Non-Refundable:

Gift cards are non-refundable and cannot be exchanged for cash under any circumstances.

Lost or Stolen Cards:

We cannot replace lost, stolen, or misplaced gift card codes. Please keep your redemption code secure and treat it like cash.

Single Use:

Each gift card can only be used once for a single transaction. Partial redemption is not available. If the purchase amount is less than the gift card value, the remaining balance is forfeited.

Delivery:

Gift cards are delivered via email with a unique redemption code immediately after purchase.

17. Modifications to Services and Pricing

We reserve the right to:

  • Modify, suspend, or discontinue any service or product at any time

  • Change pricing for services and products with reasonable notice (changes do not affect purchases already made)

  • Update package contents or features (changes do not affect purchases already made)

Customers who have already purchased services will receive the service as described at the time of purchase.

18. Modifications to Terms & Conditions

We reserve the right to update or modify these Terms & Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date at the top.

Material changes (such as changes to refund policy, pricing structure, or delivery terms) will be communicated via email to customers who have made purchases within the previous 12 months.

Your continued use of our services after changes are posted constitutes acceptance of the updated terms. If you do not agree with the updated terms, you must discontinue use of our services.

19. User Conduct

By using My Colour Season services, you agree to:

  • Provide accurate, truthful information in your purchase and photo submissions

  • Not misuse or abuse our services (including submitting photos of other people without their consent)

  • Not attempt to reverse-engineer, copy, or replicate our analysis methodology or materials

  • Treat our staff and analysts with respect in all communications

  • Not use our services for any unlawful purpose

We reserve the right to refuse service or cancel orders if we believe these terms have been violated.

20. Third-Party Services

Our website and services may integrate with or link to third-party services (such as payment processors, email providers, social media platforms).

We are not responsible for:

  • The privacy practices of third-party services

  • The terms and conditions of third-party services

  • Any damages or losses resulting from your use of third-party services

Please review the privacy policies and terms of any third-party services separately.

21. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Netherlands.

Any disputes, claims, or controversies arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Amsterdam, The Netherlands.

Before pursuing formal legal action, we encourage you to contact us first at hello@mycolourseason.com to attempt to resolve any concerns amicably.

22. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

23. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and My Colour Season (operated by Colourbella) regarding your use of our services.

These terms supersede any prior agreements, communications, or understandings (whether written or oral) relating to the subject matter herein.

24. Language

These Terms & Conditions are provided in English. If translated into other languages for convenience, the English version shall prevail in case of any discrepancies or disputes.
